ROYALTY WAIVERS/ REDUCTION FORMS:

Royalty Waiver/ Reduction Forms are to be used if you meet the criteria set in the ARA (Aggregate Resources Act) under Section 46(1),
The Minister shall determine the royalty per tonne that each aggregate permittee removing from the site aggregate or topsoil that is property of the Crown must pay, but in no case shall the royalty be less than the prescribed minimum royalty, and, in determining the royalty, the Minister shall have regard to the location, quantity, type and accessibility of the aggregate or topsoil and its intended use. R.S.O. 1990, c. A.8, s. 46 (1).
If you meet the criteria as set by the ARA, the forms must be completed, verified and submitted with the Annual Production Report (year specific). Be sure that the form is verified by the correct agent based on what type of exemption you are applying under.
Please note that the product applied for in the exemption must be submitted separately in the “Additional Commodity” section, which identifies the commodity. The product needs to be entered in the months that it left the permitted site and must be totaled. The total requested for consideration in the waiver on the production report must be the same as the verified total on the exemption form. All entries are to be in metric tonnes.
All submitted production reports are subject to audit.

ARA Forestry Waiver/Reduction

Ensure the Forestry form is verified by the authorized forestry company representative prior to submitting form to TOARC with your current year’s production report.

ARA ENDM Royalty Waiver/Reduction ARA MNR Royalty Waiver/Reduction

The process for the above MNR and ENDM forms is the same as described for MTO below. The signed form must be sent to the respective MNR or ENDM Crown Ministry for verification prior to submitting form to TOARC with your current year’s production report.

ARA MTO Royalty Waiver/Reduction

Process for completing MTO Form:
  • Aggregate Permit Holder downloads blank form from TOARC website, completes, dates and signs form and sends to MTO Geotechnical Section for verification prior to submitting form to TOARC with your current year’s production report.
  • MTO internal circulation to verify.
  • MTO returns verified form to the Aggregate Permit Holder who submits it with the current year’s production report to TOARC.
  • TOARC issues invoice to Aggregate Permit Holder (exemption only given if signed and approved by all authorized government personnel).
